1. Acceptance of Terms

By downloading, installing, or using the PlantScan application ("App") or visiting www.plantscan.org ("Website"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App or Website.

These Terms constitute a legally binding agreement between you and PlantScan. We reserve the right to update or modify these Terms at any time. Continued use of the App or Website after any changes constitutes your acceptance of the new Terms.

2. Description of Service

PlantScan is a mobile application that uses artificial intelligence to help users identify plants, flowers, herbs, and other botanical species. The App provides:

• AI-powered plant identification from photos
• Access to a database of 500,000+ plant species
• Expert care guides and growing tips
• A personal plant collection feature
• Location tracking for plant discoveries
• Premium subscription features (PlantScan Premium)

3. Subscription and Payments

PlantScan offers a free version and a Premium subscription ("PlantScan Premium"). By subscribing to PlantScan Premium, you agree to the following:

3.1 Free Trial

We may offer a 7-day free trial for new Premium subscribers. After the trial period ends, your subscription will automatically renew at the applicable subscription rate unless cancelled at least 24 hours before the end of the trial period.

3.2 Automatic Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. Payment will be charged to your App Store or Google Play account at confirmation of purchase.

3.3 Cancellation

You may cancel your subscription at any time through your device's subscription management settings. Cancellation takes effect at the end of the current billing period.

3.4 Price Changes

We reserve the right to change subscription prices. We will provide reasonable advance notice of any price changes. Continued use of the Premium subscription after a price change constitutes your acceptance of the new price.

4. Acceptable Use

You agree to use PlantScan only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools to scrape, crawl, or extract data from the App
• Reproduce, duplicate, or resell any part of the App without our express written permission
• Use the App to harass, abuse, or harm other users
• Violate any applicable local, national, or international laws or regulations

5. Accuracy of Plant Identification — Important Disclaimer

PlantScan uses AI technology to assist with plant identification. While we strive to provide accurate results, we cannot guarantee 100% accuracy under any circumstances. Please read the following disclaimer carefully before using any plant identification result.

No Liability for Harm or Injury

PlantScan, its developers, and its partners cannot be held responsible for any harm, injury, illness, poisoning, or death resulting from the use or misuse of plant identification results provided by this App. This includes, but is not limited to, cases where a user consumes, handles, or applies a plant based on an identification made by PlantScan.

Edible Plants, Herbs & Foraging

Never consume, taste, or use any plant, herb, mushroom, or berry for food or medicinal purposes based solely on an identification from PlantScan. Many edible plants closely resemble toxic or poisonous species that can cause serious illness or death. AI-based identification is not a substitute for expert knowledge when it comes to foraging or consuming wild plants.

When to Consult a Professional

You should always consult a qualified plant specialist or botanist in the following situations:

• Before consuming any wild plant, herb, berry, or mushroom
• When identifying plants for medicinal or therapeutic use
• If a child or pet has come into contact with or ingested an unknown plant
• When you need a legally or medically reliable plant identification
• In any situation where an incorrect identification could result in harm

In Case of Poisoning

If you or someone else has ingested a plant and you suspect poisoning, do not rely on PlantScan for guidance. Contact your local emergency services (112 / 911) or a poison control center immediately.

General Limitations

• Plant identifications are provided for informational and educational purposes only
• Identification accuracy may vary depending on photo quality, lighting, angle, and plant condition
• Some plant species are visually very similar and may be difficult to distinguish even for experts
• Results should always be cross-checked with a qualified botanist or plant specialist when accuracy is critical

6. Intellectual Property

All content, features, and functionality of the PlantScan App and Website — including but not limited to text, graphics, logos, icons, images, and software — are the exclusive property of PlantScan and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:

• Copy, modify, or distribute the App or its content
• Use the App for commercial purposes without our written consent
• Remove or alter any proprietary notices or labels

7. User Data

When you use PlantScan to identify a plant, photos are transmitted to our AI processing partner, rork.ai, solely for the purpose of performing the plant identification. We want to be fully transparent about how your data is handled:

• Photos are transmitted to rork.ai only to process your plant identification request
• Your photos are not stored after processing is complete
• Your photos are not sold to any third party
• Your photos are not used for advertising, profiling, or any purpose other than identifying the plant in your image
• No personal information is collected or retained in connection with your photos

PlantScan does not collect, store, or use any other personal information or data from its users beyond what is described above.

8. Privacy

Your use of PlantScan is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.

9. Disclaimer of Warranties

PlantScan is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• Any errors or defects will be corrected
• The App or its servers are free of viruses or other harmful components
• The results obtained from using the App will be accurate or reliable

10. Limitation of Liability

To the fullest extent permitted by applicable law, PlantScan and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from:

• Your use of or inability to use the App
• Any unauthorized access to or use of our servers or your personal information
• Any errors or inaccuracies in the App's content
• Any actions taken in reliance on plant identifications provided by the App

11. Third-Party Links and Services

The App and Website may contain links to third-party websites or services (such as the Apple App Store and Google Play Store). These links are provided for your convenience only. PlantScan has no control over the content or practices of these third-party sites and assumes no responsibility for them. We encourage you to review the terms and privacy policies of any third-party sites you visit.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts.

13. Changes to These Terms

We reserve the right to update these Terms of Use at any time. We will notify users of significant changes by updating the "Last updated" date at the top of this page. We encourage you to review these Terms periodically. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.
